Terms of Service

These Terms of Service ("Terms") govern your use of Ready Reputation at readyreputation.com ("the Platform"). Ready Reputation is a service of Brooklyn Beach Design LLC ("we," "our," "us"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

Brooklyn Beach Design LLC is based in Palm Desert, California. These Terms are governed by the laws of the State of California.

1. Services Provided

The Platform provides local businesses with tools to manage and grow their online reputation, including:

  • Review Aggregation: Collecting and displaying reviews from connected platforms (Google, Yelp, Facebook, and others) in a unified dashboard.
  • AI-Powered Review Responses: Automatic AI-generated replies for supported review channels. For other platforms, AI-drafted replies are provided for you to post manually.
  • Review Request Campaigns: Sending email, SMS, and WhatsApp campaigns to your customers requesting reviews or private feedback.
  • Social Proof & PR Amplification: Formatting genuine public praise into website proof, social content, and PR-ready material as part of the service.
  • Analytics & Reporting: Dashboard tools including Review Statistics, Ranking & Competitors, Google Performance, AI Visibility Ranking, and review & keyword insights.
  • Website Widgets: Embeddable review carousels, grids, and pop-ups for your website where included in your service package.

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years of age or the legal age of majority in your jurisdiction.
  • Have the legal authority to enter into binding agreements on behalf of your business.
  • Comply with these Terms and all applicable local, state, federal, and international laws.

3. Account Registration

You agree to provide accurate, complete, and current information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at reviews@readyreputation.com if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that contain inaccurate information or that violate these Terms.

4. Subscriptions & Payment

The Platform is offered on a monthly subscription basis. By subscribing, you agree to:

  • Pay the applicable fees for your chosen plan as listed on the pricing page at the time of subscription.
  • Provide accurate payment information. Payments are processed securely through Stripe.
  • Authorize recurring monthly charges until you cancel your subscription.

All fees are billed in US dollars. We reserve the right to change pricing at any time. Price changes will take effect at the start of your next billing cycle with advance notice.

Free Trial: All plans include a 7-day free trial. No credit card is required to start. If you subscribe after the trial, your first charge occurs at the end of the trial period.

Refunds: All fees are non-refundable. We do not offer refunds or credits for partial months, unused periods, or plan downgrades, unless otherwise required by California law or agreed upon in writing by Brooklyn Beach Design LLC.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting us at reviews@readyreputation.com. Upon cancellation, your access to the Platform will continue until the end of your current paid billing period.

5. Acceptable Use

You agree not to use the Platform to:

  • Solicit, create, or post fake, incentivized, or misleading reviews in violation of Google, Yelp, FTC, or any other applicable platform guidelines.
  • Harass, threaten, or discriminate against any customer or third party.
  • Violate any applicable law or regulation.
  • Reverse-engineer, copy, or redistribute any part of the Platform without written consent.
  • Use the Platform in any way that could damage, disable, or impair its operation.
  • Upload or transmit malicious code, spam, or unauthorized commercial communications.

Violation of these restrictions may result in immediate account termination without refund.

6. Review Request & FTC Compliance

The Platform is designed around a fair two-choice flow. Customers may share their experience publicly or contact the business directly, and the path must not change based on a rating. You agree not to use the Platform to offer payment, discounts, perks, or other consideration for reviews, create fake or misleading reviews, suppress criticism, or otherwise violate Google, Yelp, FTC, or other applicable platform guidelines.

7. Artificial Intelligence

The Platform uses AI to generate review responses and may assist with social proof content. By enabling these features, you agree that you are responsible for configuring accurate business information and parameters that govern AI outputs, and that we are not liable for any AI-generated content including inaccurate, inappropriate, or unintended responses.

8. Customer Data & Campaign Compliance

When you upload customer contact information or send campaigns through the Platform, you represent that you have obtained all necessary consents, that your campaigns comply with CAN-SPAM, TCPA, CTIA, GDPR, and all applicable laws, and that you are solely responsible for the legality of your campaigns and data.

9. SMS Messaging Program Terms

By opting in to receive text messages from Ready Reputation, you agree to receive customer care messages, account notifications, review campaign updates, and promotional messages. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase.

10. Intellectual Property

All Platform content and software is owned by Brooklyn Beach Design LLC or licensed to us. You retain ownership of your business and customer data. By using the Platform you grant us a limited license to use that data solely to provide the described services.

11. No Guarantee of Results

We do not guarantee any specific outcomes including new reviews, improved Google rankings, increased traffic, leads, revenue, or removal of negative reviews. Results will vary by business, industry, and market.

12. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Platform will be error-free, uninterrupted, or free of security vulnerabilities. You use the Platform at your own risk.

13. Limitation of Liability

To the maximum extent permitted by California law, Brooklyn Beach Design LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed fees paid to us in the three months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Brooklyn Beach Design LLC from any claims arising out of your use of the Platform, violation of these Terms, or campaigns you send through the Platform.

15. Termination

We reserve the right to suspend or terminate your access at any time for violations of these Terms, non-payment, or fraudulent activity. You may cancel at any time by contacting reviews@readyreputation.com.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California. Disputes shall be resolved in the state and federal courts of Riverside County, California.

17. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated at least 14 days before taking effect. Continued use constitutes acceptance.
